1. Acceptance of Terms

By accessing and using this SMS gateway service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Laravel provides bulk SMS messaging services to businesses and organizations. Our platform allows users to send SMS messages to recipients worldwide.

3. User Accounts

To use our Service, you must:

  • Provide accurate and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and identification
  • Notify us immediately of any unauthorized use of your account
  • Use the Service in accordance with all applicable laws and regulations

4. Acceptable Use Policy

You agree NOT to use the Service:

  • To send spam, unsolicited, or unwanted SMS messages
  • To send messages containing illegal, harmful, threatening, abusive, harassing, defamatory, or objectionable content
  • To violate any applicable local, state, national, or international law or regulation
  • To transmit any viruses, malware, or other destructive code
  • To impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • To send messages that violate recipient privacy or data protection laws
  • To send marketing messages without proper consent (as required by local regulations)

5. Compliance with Regulations

5.1 TCPA Compliance (USA)

For SMS sent to United States recipients, you must comply with the Telephone Consumer Protection Act (TCPA), including:

  • Obtaining explicit written consent before sending marketing messages
  • Providing clear opt-out instructions in every message
  • Honoring opt-out requests immediately (within 15 minutes)
  • Maintaining records of consent

5.2 DLT Compliance (India)

For SMS sent to Indian recipients:

  • You must register with the Telecom Regulatory Authority of India (TRAI)
  • All promotional messages must have DLT Entity ID
  • Transactional messages require proper headers and templates
  • Adherence to TRAI guidelines and regulations

5.3 GDPR Compliance (EU)

For EU recipients, compliance with General Data Protection Regulation (GDPR) is mandatory:

  • Obtain explicit consent for marketing communications
  • Provide clear privacy notices
  • Honor data subject rights (access, erasure, portability)
  • Implement appropriate security measures

5.4 Canada Anti-Spam Legislation (CASL)

For Canadian recipients:

  • Obtain express or implied consent
  • Identify yourself and provide contact information
  • Provide easy unsubscribe mechanism
  • Maintain records of consent

6. Payment Terms

6.1 Pricing

All pricing is displayed in our pricing page and may vary based on destination and route. We reserve the right to modify pricing at any time with 30 days notice.

6.2 Refunds

  • No refunds for delivered messages
  • Credit refunds may be provided for failed deliveries at our discretion
  • Account balance is non-transferable and non-refundable unless required by law

6.3 Prepaid Accounts

Accounts operate on a prepaid basis. You must maintain sufficient balance to send messages. Low balance may result in service suspension.

7. Delivery and Service Availability

  • We aim for 99.9% uptime but do not guarantee uninterrupted service
  • Message delivery is dependent on carrier and network availability
  • We are not responsible for messages not delivered due to carrier issues, blocked numbers, or invalid recipients
  • Message delivery times may vary based on network conditions

8. Intellectual Property

All content, features, and functionality of our Service are owned by Laravel and are protected by copyright, trademark, and other laws. You may not:

  • Copy, modify, or distribute our platform
  • Use our branding without permission
  • Reverse engineer our systems

9. Data and Privacy

Your use of our Service is also governed by our Privacy Policy. By using our Service, you consent to:

  • Collection and processing of personal and technical data
  • Data storage and transfer across our infrastructure
  • Communication for account-related and service notifications

10. Limitation of Liability

Laravel SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Delays or failures in message delivery
  • Loss or corruption of data
  • Security breaches beyond our reasonable control

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Laravel, its affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Content you send through our Service

12. Account Suspension and Termination

12.1 Suspension

We may suspend your account immediately if:

  • You violate these Terms
  • You engage in prohibited activities
  • Your use threatens system security or stability
  • Required by law enforcement or court order

12.2 Termination

Either party may terminate this agreement:

  • You may cancel your account at any time
  • We may terminate accounts that are inactive for 12+ months
  • We may terminate immediately for violation of these Terms

12.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease immediately
  • Outstanding balance may be forfeited if account was terminated for violation
  • We will retain your data for 90 days, then delete it (unless required by law)

13. Dispute Resolution

13.1 Governing Law
